May 15, 2008 ND SECTION 18 FOR SPARTAN IN FLAX The U.S. Environmental Protection Agency has issued a Section 18 specific exemption for Spartan 4F, allowing North Dakota flax producers to use the herbicide to control kochia and ALS resistant kochia. The exemption allows a single ground application of 3 to 8 fluid ounces of Spartan 4F per acre, depending on soil type. The application must be made up to 30 days before and three days after planting. Applicators must follow all directions, restrictions and precautions on both the Section 18 use directions and the EPA registered product label. They must have a copy of the Section 18 use directions in their possession during application. Users of Spartan 4F under this exemption are required to comply with both the full product labeling and the exemption use directions. A special thanks goes out to Dr. Brian Jenks the North Central Research Extension Center for this one. If you recall, we did not have this exemption available in 2007 due to a lack of data to the economic loss arguments for the pest situation being an emergency. Brian initiated field experiments last year to fill these data gaps, and results from these experiments were critical to make our case and complete the Section 18 exemption request document this year. Rich Zollinger, Extension Weed Specialist Livestock Water Assistance Program - In response to Governor Hoven’s May 9th declaration of a state drought emergency, the North Dakota State Water Commission met yesterday, May 14, and approved $1 million in funding to reactivate the Drought Disaster Livestock Water Supply Project Assistance Program. The Program is designed to provide 50 percent cost-share assistance to livestock producers with livestock water supply shortages caused by drought. Cost-share assistance is limited to no more than $3,500 per project with a limit of three projects per applicant and a total cost-share limit of $10,500. According to the State Water Commission about 100 ranchers had already requested applications for financial help even before yesterday’s announcement, so if you are interested in requesting cost-share assistance for livestock water projects, don’t delay in getting your request submitted. Following are the specifics on the 2008 Drought Disaster Livestock Water Supply Assistance Program from the NDSWC website: Background - The Drought Disaster Livestock Water Supply Project Assistance Program (Program), established by the North Dakota Legislature in 1991, provides cost-share assistance to livestock producers with water supply shortages caused by drought. The Program is administered by the North Dakota State Water Commission. Eligibility - Any North Dakota livestock producer who has failed stock-water supplies due to drought is eligible for the program. A “livestock producer” means an individual who produces livestock or operates a dairy farm, who normally devotes a major portion of the individual’s time to the activities of farming or ranching, and has a typical year cash flow projection showing at least 50% of the producer’s gross income coming from livestock production. Eligible items include new water wells, rural water system connections, pipeline extensions, pasture taps, pumps, generators, electrical and solar hook-ups, stock water tanks; and labor, materials, and equipment rentals for work completed by the producer. • The applicant must have been denied Farm Service Agency Emergency Conservation Program (ECP) cost-share assistance. The county FSA office will provide a letter of denial to the producer. • The Commission will fund the program to the extent funding is available. Priority for funding will be based on the earliest date of application. • Cost-share assistance may only be used for water supply projects that will provide a long term solution to a drought-related water supply shortage. • All wells drilled with funds provided through this program must be drilled by a North Dakota certified water well contractor (A listing of ND certified water well contractors is available on the NDSWC website). • The applicant may receive up to 50% of the eligible costs, but no more than $3,500 per project with a limit of three projects per applicant. The following projects are not eligible for funding from the Drought Disaster Livestock Water Supply Project Assistance Program. • Rehabilitation of an existing well • A water supply project on federal or state land • A dry hole drilled in an attempt to construct a water well or to locate a water source • The construction of stock dams or dugouts • Projects that require repair or replacement as a result of failure to provide maintenance to an existing water source Application - Applicants are required to submit to the Commission: 1. A cost-share assistance application; 2. A map and/or aerial photo of the project area; 3. A letter of denial for assistance from the FSA; and 4. An estimate of project costs.
