Reporting Pesticide Spills The North Dakota Department of Agriculture met this summer with officials from the North Dakota Department of Health and the State Emergency Response Commission to discuss some problems that developed when pesticide spills were not reported to the proper authorities. State law requires that spills that cause unreasonable adverse effects on the environment be reported to the North Dakota Department of Agriculture (328-2231) within 24 hours of the spill. These spill reporting requirements are found in the Pesticide Act on page 33 paragraph 60-03-01-09. Also, the State Emergency Response Commission must abe notified of all spills by calling the state radio hazard communications number (1-800-472-2121). SARA Title III may also require that you report spills. Contact the State Emergency Response Commission for further information on these requirements. Finally, the North Dakota Department of Health Division of Water Quality requires reporting of any spill under Chapter 61-28 of the NDCC. They can be reach at 328- 5210.
