More than 73 tons of waste pesticides collected
This issue marks the first time that that the NDSU Pesticide Quarterly has been mailed to all 17,000 North Dakota private and commercial certified pesticide applicators and dealers. Since 1981 it has been distributed exclusively to commercial applicators and dealers. It is published four times per year by the NDSU Extension Pesticide Program. The PQ contains timely and relevant information on use issues, regulatory requirements, and information about certified applicator training opportunities.
The January issue of the PQ will be distributed to all certified applicators in the state. Commercial certificate holders will continue to receive all four issues of the PQ without interruption. Private applicators will receive the April, July, and October issues only upon request. There is no subscription fee for this newsletter. To request the PQ, go to our home page at http://ndsupesticide.org and subscribe on-line.
The pesticide program has been gearing up for a really big certification year due to the anticipated influx of new applicators as a result of the legislature's new pesticide laws. In this issue you'll see many more commercial trainings than in previous years and you will see a greater variety of category offerings than ever before. (Private applicators please note: your trainings are available through your local NDSU Extension Service County Office).
If your certification(s) are due to expire April 1, 2002, or you are new to the system, have a look at our commercial training calendar and make plans now to register. I encourage you to preregister, this will reduce your certification costs by almost 20% and it means that you will only have to show up 15 minutes early to sign in at the training site. No filling out forms, just your signature is needed and you will receive confirmation via mail that your preregistration has been received and a reminder about your training date(s).
You might have noticed over the past couple of years that the pesticide program has been aggressively adopting technology to better deliver our programs and minimize bureaucratic hassles. This year we will be using it in several new ways to deliver our programs.
First, when you give us your e-mail address, we can now use it to send you notices when your certifications have been processed and we can mail you notifications as to when the Pesticide Quarterly has been posted on the web.
Second, we will be rolling out an on-line fumigation training and an on-line testing program in a handful of county extension offices this winter. This will give you another option to maintain your certifications and speed up the processing of certification exams. After piloting the system this year, we hope for a statewide roll out in 2003.
Third, we are using the North Dakota Interactive Video Network to deliver fumigation training to a record number of locations across the state. In previous years we only had two fumigation training sites available, now we have more than a dozen.
Finally, we are experimenting with internet video conferencing to add live state specialist participation to trainings that would ordinarily be delivered by a dated videotape.
These are exciting times in the pesticide program and we hope that these additions to our program will improve the quality of how we do business.

The most recent legislative session has resulted in some changes in the pesticide laws that will be evident in the 2002 season. First, and foremost, is the new requirement that all commercial applicators of general and restricted use pesticides must be certified in the proper category. There is a provision that applicators of general use pesticides may apply under the direct supervision of a properly certified supervisor. This provision does not apply to aerial applicators, all of whom must be certified.
NDDA pesticide inspectors have been instructed that during a use inspection, an applicator of a general use pesticide that is not certified must be able to contact his/her supervisor immediately and that person must be able to come to the application site within a reasonable amount of time. Failure to appear within a reasonable period of time, to be measured in minutes, will result in a violation.
When conducting use inspections, proof of Financial Responsibility must be provided to the inspector. Absent this proof, the inspector will immediately suspend the applicator's certification and the application until that requirement is met. The new language of the law regarding Financial Responsibility requires this suspension.
The NDDA has also stated that they will be doing more Worker Protection Standard inspections and enforcement actions starting in the 2002 season. These inspections will cover all WPS requirements.
It was also noted that new bulk pesticide rules regarding the storage, packaging and repackaging of bulk pesticides will become effective soon. This is an advanced workshop for individuals who desire the latest information on soil fertility, crop management, and information technology. This program is designed for crop consultants, agronomists, ag dealers, extension agents, and industry representatives. The program begins with registration at 8:30 a.m. on Feb. 21 in the NDSU Memorial Union Dakota Ballroom. It concludes Feb. 22 at 1:30 p.m. Continuing education credits for certified crop advisors will be available.
The number of workshop participants will be limited to 150. Preregistration (including fee payment) is required as workshop enrollment will be filled on a firstcome/firstserve basis.
Workshop fee is $125 per person ($75 for one day attendance). The fee covers the cost of refreshment breaks, meals, social and reference materials. A full refund of the preregistration fee will be provided if requested by February 15.
A confirmation letter will be sent to persons who have preregistered (completed form and paid fee) to confirm their enrollment in the workshop.
Reservations for lodging may be made directly with motels in the Fargo/Moorhead area. A block of rooms has been reserved at a reduced rate until February 8 at the Kelly Inn, 3800 Main Ave., Fargo, phone (701) 2822143. Workshop participants must make their own lodging arrangements.
NDSU campus parking passes will be available for workshop participants. Car pooling is strongly encouraged when traveling to campus to reduce competition for limited parking spaces.
BISMARCK - Mark Dooley, Casselton, and Glen Wharam, Park River, are North Dakota's outstanding pesticide applicators of 2001, and Brian Johnson, Hatton, is the outstanding pesticide dealer of the year.
The awards were presented during the recent North Dakota Agricultural Association Short Course and Trade Show in Fargo.
"Mark won the dealer award back in 1992 and is the first double winner in these awards," said Agriculture Commissioner Roger Johnson. "Mark, Glen and Brian have done an exemplary job of providing customers with effective and affordable crop protection, while helping ensure protection of the environment."
Dooley has been employed by Chaffee Lynchburg Elevator for 15 years, and currently supervises a staff of 12 full-time applicators who spray more than 100,000 acres annually.
A pilot since 1969, Wharam has managed an aerial and ground application business, Valley Sprayers, Inc., since 1995. The company annually sprays between 60,000 and 70,000 acres.
The manager of the UAP Northern Plains facility in Hatton since 1995, Johnson sells agricultural chemicals and seed and scouts fields.
The North Dakota Department of Agriculture (NDDA) and the North Dakota Agricultural Association cooperatively present the annual awards. Winners are nominated by NDDA consumer protection inspectors.
Editors note: What follows are extracts from the minutes of a pesticide working group that convened in November and met in Bismarck under the auspices of the North Dakota Department of Agriculture. Representatives from the department, NDSU Extension Service pest management specialists, representatives from major commodity groups, and pesticide manufacturers were in attendance. The minutes list the work that has and will be conducted to secure special pesticide registrations for the year 2002 and beyond.
Jim Gray from the North Dakota Department of Agriculture presented a summary of the Section 18 exemptions requested and granted in 2001. The Department requested 21 Section 18 exemptions in 2001; all but one were approved. The Department also declared two crisis exemptions in 2001. Consistent with past years, North Dakota led Midwestern states with the number of Section 18 exemptions requested and granted. Gray also presented a summary of the Section 24(c) registrations issued by the North Dakota Department of Agriculture in 2001, and provided meeting participants with a list of all active Section 24(c) registrations in North Dakota. Gray also updated meeting participants with highlights from EPA pesticide registration actions from fiscal year 2001. Participants were provided with a copy of "FY2001 Report of Conventional Pesticide Registration Decisions" from EPA's Registration Division. This was followed by a discussion of EPA's FY2002 pesticide registration work plan, with a focus on pending registration actions with an impact on North Dakota agriculture.
Dr. Brian Jenks and Dr. Rich Zollinger from NDSU discussed herbicide Section 18 exemption needs for 2002. The proposed herbicide Section 18 exemptions for 2002 can be found in Table 1. There are three new Section 18 exemptions planned for 2002. These include imazamox in Clearfield sunflowers to control cocklebur, dimethenamid in sunflowers to control Powell amaranth, and sethoxydim in buckwheat to control wild oats. Use of sethoxydim in buckwheat was covered under a crisis exemption in 1999. However, this use has never been covered under a specific Section 18 exemption.

Use of paraquat in seed peas has been covered under a Section
18 exemption for the past several years. However, a permanent tolerance
for paraquat in peas was recently
published in the Federal Register.
The NDDA will investigate whether
a Section 24(c) registration can be issued for this use. If this use can
be covered under a Section 24(c) registration, a Section 18
exemption will not be needed.
Several weed species were identified that are new to North Dakota or becoming especially problematic in the state. These include wild buckwheat, marshelder, and biennial wormood. These weeds will be continually monitored, and if needed, addressed through Section 18 exemptions.
Dr. Phil Glogoza discussed potential insecticide Section 18 exemptions for 2002. The Section 18 exemption for use of coumaphos (CheckmiteÒ) strips in beehives was the only insecticide exemption for 2001. Since varroa mites and small hive beetles are still major pests for beekeepers, we will most likely need a Section 18 exemption for this use in 2002. Jeff Olson from the North Dakota Department of Agriculture provided comment on the alleged misuse of the product under the exemptions granted in both 2000 and 2001. Olson stressed that the North Dakota Department of Agriculture will continue to inspect beehives and levy fines if misuse of coumaphos is found.
Dr. Glogoza also commented on a number of insect pest problems that are challenging for North Dakota producers. Most of these pests have been a nuisance in the past, but have the potential to be much more serious if optimal conditions exist. Although specific exemption requests are not planned for these pest problems, we should be ready to declare a crisis exemption if an emergency outbreak occurs. These include: thrips in barley, bertha armyworm in dry mustard, soybean aphid in soybeans, lygus plant bug in sunflowers, and lygus plant bug in sugarbeet.
Dr. Marcia McMullen facilitated a discussion on fungicide Section 18 exemptions for North Dakota. Proposed fungicide Section 18 exemptions for North Dakota in 2002 can be found in Table 2.

A Section 18 exemption for use of fenamidone in sunflowers to
control downy mildew was also discussed. We will monitor sunflowers for
downy mildew, and possibly submit a Section 18 exemption request.
In addition to the previously mentioned emergency disease problems, Anthracnose has been detected in North Dakota dry bean fields. This disease is one the most serious diseases affecting dry beans. Since an effective fungicide is not available for control of this disease, a Section 18 exemption is not proposed for 2002. However, NDSU and the dry bean growers will continue to monitor the spread of Anthracnose in North Dakota.
Rhizoctonia (root rot) is an emerging disease problem for North Dakota sugarbeet producers. Similar to downy mildew in sunflowers and Anthracnose in dry beans, this disease will be monitored.
Many of the proposed Section 18 exemption requests for 2002 are included in the 2002 work plan for EPA's Registration Division. Therefore, we may not have to submit some Section 18 exemption requests if a full registration is granted prior to the intended use season. Applicable registration packages can be found in Table 3.

The work plan dates for sethoxydim in safflower, sulfentrazone in
sunflowers, and tetraconazole in sugarbeets will most likely not meet the use
seasons for North Dakota. However, a full registration for imazamox in
canola and legumes, azoxystrobin in legumes, and clopyralid in canola
and flax may be available by this upcoming use season. The North
Dakota Department of Agriculture will consult with EPA's Section 18 Team
to determine whether submission of
a Section 18 exemption request for these uses is necessary.
A full registration for use of pyraclostrobin (BAS 500Ò) in several crops is scheduled for EPA review in first quarter of FY2002. According to the recently released EPA work plan, registered crops will include sugarbeet, small grains, potatoes, and several vegetables. It is believed that this registration package will also include legume vegetables. This would be good news for North Dakota chickpea and lentil growers because pyraclostrobin has demonstrated good activity against Ascochyta. If the registration does cover legumes, a Section 18 exemption for azoxystrobin in chickpeas and lentils will not be needed.
A BASF representative has also informed the North Dakota Department of Agriculture that a full registration for imazapic in range and pasture is anticipated for first quarter of FY2002. The Department will verify this with both EPA's Registration Division and BASF registration personnel. If this registration is granted, this will also reduce the number of Section 18 exemption submissions for 2002.

Nearly 370 North Dakota farmers, ranchers, pesticide dealers, applicators, and other people delivered more than 73 tons of unusable pesticides to Project Safe Send collection sites during July of 2001. Authorized by the Legislature and conducted by NDDA, Project Safe Send is funded by the fees pesticide manufacturers pay to register their products in the state.
"This collection was one of the most successful we've had in the nine years Project Safe Send has been in operation," said Agriculture Commissioner Roger Johnson. "Although the tonnage was slightly greater in 2000, we had more participants this year."
This year, 369 persons brought in 147,857 pounds of unusable pesticides including DDT, mercury, arsenic, chlordane, toxaphene and other dangerous chemicals to 21 collection sites. Participation numbers and pounds collected per site are listed in the following table.
Dealers, applicators and farmers with unusable or banned pesticides will once again be able to get rid of them safely and free of charge in July of 2002. The North Dakota Department of Agriculture (NDDA) will soon be selecting the sites and dates for pesticide collection. You can call NDDA or your county agent this spring for the details.
