Hazardous Substances Used in North Dakota Agriculture

A-947 (Revised)
Reviewed and reprinted September 1997

Definitions and Explanations
Reporting Requirements SARA (Title III)
Reporting Spills or Accidental Releases
Reportable Quantity and Threshold Planning Quantity for Pesticides
Section 304 Form (Instructions for Reporting Spills)
302 Farm Report

This list has been prepared to help answer inquiries concerning hazardous substance reporting under Superfund Amendments and Reauthorization Act (SARA), Title III Emergency Planning and Community Right-to-Know Act of 1986.

All efforts have been made to include pesticides commonly, or in some instances, not commonly used in North Dakota. A few pesticides are listed that have been cancelled by EPA. Such chemicals are listed because situations may occur in which they are being held in long-term storage and, due to container deterioration, are in danger of being released into the environment.

Definitions and Explanations

The abbreviations R.Q. and T.P.Q. are used at the heading of the two columns on the right hand side of the table. These abbreviations are defined below:

R.Q.:
Reportable Quantity
of the chemical in pounds of active ingredient. Reporting is required in the event of an accidental release and/or spill of any of these chemicals at, or in excess of, the quantities indicated.

T.P.Q.:
Threshold Planning Quantity
of the chemical in pounds of active ingredient. Any chemicals stored at or in excess of the amounts listed in the tables must be reported to the North Dakota Division of Emergency Management, the local county emergency planning committee, and the local fire department. A material data safety sheet (MSDS) pertaining to each chemical must accompany the T.P.Q. report filed for each chemical.

You will note that some chemicals in the T.P.Q. column have two different numbers. The lower figure denotes the solid or liquid formulation of the product (ex. Furadan 4F), the larger number denotes the granular formulation of the product (ex. Furadan 15G). Both figures are in pounds of active ingredient. To assist readers in making T.P.Q. determinations, the percentages and/or pounds of active ingredient per gallon for each pesticide are given.

Reporting Requirements SARA (Title III)

The Superfund Amendments and Reauthorization Act (SARA) has a number of reporting requirements. They are: Emergency Planning (Section 302), Emergency Notification/Accidental Release (Section 304), Material Safety Data Sheets/Chemical List (Sections 311 and 312) and Toxic Chemical Release Reporting (Section 313). Considerable confusion exists about to whom these reports should be submitted.

Section 302 -- Emergency planning (storage information) and Section 304 -- Emergency Notification/Accidental Release or Spills are the most common for farmers to be concerned about. Farmers are exempt from Tier II reporting (Sections 311, 312, 313). Farmers who are also commercial applicators or resell pesticides may be required to meet all reporting requirements (Sections 302, 304, 311, 312, 313).

SARA mandates that reports on storage or spills be submitted to:

  1. State Emergency Response Commission
  2. Local Emergency Planning Committee
  3. Local Fire Department

The State Emergency Response Commission has designated the North Dakota Division of Emergency Management as the state agency responsible for collection of reports. All written reports and questions about report forms submitted under SARA, regardless of the section, should be submitted to:

Division of Emergency Management
Box 5511
Bismarck, ND58502-5511

Ask for:
Bob Johnston (701) 328-2111
Ray DeBoer (701) 328-2111

Reports for the local Emergency Planning Committee should be sent to the County Emergency Manager.

Reporting Spills or Accidental Releases

Verbal notification of an accidental release or spill of a hazardous substance within North Dakota in an amount equal to or greater than the reportable quantity (R.Q.) from the table must be made to:

N.D. Division of Emergency Management 1-800-472-2121
From outside North Dakota (701) 328-2121
Local Emergency Planning Committee _____________
Local fire department _____________
National response center 1-800-424-8802

Emergency notification must include this information:

  1. Name of chemical.
  2. Indication of the acute and chronic health risks of the substance.
  3. Estimate of the quantity of the chemical released.
  4. 4Location of the release.
  5. Time and duration of the release.
  6. Environmental medium into which the release occurred (air, water, soil, etc.).
  7. Indication of whether the substance is extremely hazardous.
  8. Proper precautions (for example, is evacuation neccessary?)
  9. Name and telephone number of the contact person.

A written follow-up report is required and must include information about:

  1. Update information included in the initial, telephone notice.
  2. Actual response actions taken.
  3. Any known or anticipated data about the health risks associated with the release.
  4. Any advice provided regarding medical attention for those individuals exposed to the chemical.

Reportable quantity and threshold planning quantity for pesticides used in North Dakota and listed by the EPA on the Hazardous Substance List.
