Dahl, Extension Pesticide Program Specialist Definitions and Explanations This list has been prepared to help answer inquiries concerning hazardous substance reporting under Superfund Amendments and Reauthorization Act (SARA), Title III Emergency Planning and Community Right-to-Know Act of 1986. All efforts have been made to include pesticides commonly, or in some instances, not commonly used in North Dakota. A few pesticides are listed that have been cancelled by EPA. Such chemicals are listed because situations may occur in which they are being held in long-term storage and, due to container deterioration, are in danger of being released into the environment. Definitions and ExplanationsThe abbreviations R.Q. and T.P.Q. are used at the heading of the two columns on the right hand side of the table. These abbreviations are defined below:
You will note that some chemicals in the T.P.Q. column have two different numbers. The lower figure denotes the solid or liquid formulation of the product (ex. Furadan 4F), the larger number denotes the granular formulation of the product (ex. Furadan 15G). Both figures are in pounds of active ingredient. To assist readers in making T.P.Q. determinations, the percentages and/or pounds of active ingredient per gallon for each pesticide are given. Reporting Requirements SARA (Title III)The Superfund Amendments and Reauthorization Act (SARA) has a number of reporting requirements. They are: Emergency Planning (Section 302), Emergency Notification/Accidental Release (Section 304), Material Safety Data Sheets/Chemical List (Sections 311 and 312) and Toxic Chemical Release Reporting (Section 313). Considerable confusion exists about to whom these reports should be submitted. Section 302 -- Emergency planning (storage information) and Section 304 -- Emergency Notification/Accidental Release or Spills are the most common for farmers to be concerned about. Farmers are exempt from Tier II reporting (Sections 311, 312, 313). Farmers who are also commercial applicators or resell pesticides may be required to meet all reporting requirements (Sections 302, 304, 311, 312, 313). is to be filled out after an accident and to be used as a guide
when calling your LEPC coordinator, the SERC and the National Response Center. This form (No. 1-11) is designed to assist
you when providing verbal information. Send a completed copy of this Notification Form to your LEPC and to the SERC.
The LEPC report should go to the County Emergency Manager. The SERC report should go to the Division of
Emergency Management in Bismarck.

Friez, Chairman, State Emergency Response Commission Dear Mr. Friez: This letter will serve as notification to your office that my farming operating does handle Extremely Hazardous Substances (EHS) under SARA Title III at or above the Threshold Planning Quantity (TPQ). This letter is my Section 302 Notification. Chemical Max Quantity on Site (pounds) Dates on Site The chemicals covered in this 302 Notice are located at the following address: It is my understanding that, because I use the above mentioned chemicals in routine farming oeprations, I am exempt from Tier II Reporting(Section 312). The Accidental Release Emergency Notification Provision (Section 304) of the law DOES APPLY to any chemical spill I may have at or above the Reportable Quantity (RQ). Spills/releases of hazardous chemicals MUST BE REPORTED to the County LEPC and the State, as well as to the National Response Center. To report to the State, call 1-800-472-2121 and ask for the Division of Emergency Management (DEM) React Officer. To report to the National Response Center, call1-800-424-8802. The penalty for not reporting spills/releases can be $25,000 or more per day.
